What is expert evidence?

Expert evidence is the opinion of an expert or professional with particular expertise in a specialised field. An expert witness is not an advocate for a party and has a paramount duty to assist the court impartially on matters relevant to their area of expertise.

Experts evidence on legal costs can be used:

  • In support of an application for security for costs
  • In support of a gross sum costs application
  • To establish quantum in a legal costs dispute
